Employment Law Roundtable 2015 in Review

On December 15, 2015, the annual Employment Law Roundtable: Current Case Law and Issues in Employment Law was held. Taking place at the New Jersey Law Center in New Brunswick, the event focused on myriad employment law cases that inspired significant changes to the field in 2015. Further, the event covered how these changes affects employment law practices and clients. Speaking at the event was The Sattiraju & Tharney, LLP’s very own Ravi Sattiraju, who has more than 15 years’ worth of experience litigating employment matters in state and federal court.

Continuing Legal Education

The Employment Law Roundtable was more than just an informative event; the program was approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for Continuing Legal Education (CLE) credit hours for certification in civil trial law. Topics Covered at the Employment Law Roundtable 2015

The employment law topics presented upon at the Roundtable this year were vast, and included:

  • Wage and hour developments;
  • The Affordable Care Act;
  • LGBT updates;
  • Employment arbitration agreements;
  • Workplace investigations;
  • Whistleblower claims;
  • Independent contracts;
  • Women’s issues;
  • Social media and employment law; and
  • Ethical issues relating to employment litigation.

Specifically, Mr. Sattiraju presented upon the New Jersey Supreme Court’s decision in Hargrove v. Sleepy’s, a decision that will have far-reaching effects for both employees and employers. In summary, the court determined that the ABC test shall be applied in determining whether or not a worker is an independent contract or an employee.

Mr. Sattiraju also discussed the significance of Uber driver litigation in California, where a federal judge recently validated the claim of the drivers that they had been misclassified as independent contractors.

Further, Sattiraju’s speech covered the topic of independent sales contractors and truck driver litigation. In regards to the latter, Sattiraju discussed how it can be useful to assess how states with the ABC test have applied the test in regards to truck driver classification.
